Introduction

Welcome to Simply, a product of ABAST AL-HALLOUL For Communications (“ABAST AL-HALLOUL”). By accessing or using Simply, including our website, mobile application, and services related to eSIM card reselling (collectively referred to as “Simply”), you agree to comply with and be bound by these Terms of Use (“TOU”). If you do not agree with these TOU, please refrain from using Simply.

1. Definitions

“Simply” refers to the website, mobile application, and all related services provided by ABAST AL-HALLOUL for eSIM card reselling.

  • “User” refers to any individual or entity accessing or using Simply.

  • “eSIM” refers to an embedded SIM card that allows users to activate a cellular plan without the need for a physical SIM card.

2. User Obligations

  • Eligibility: Users must be at least 18 years old or have the consent of a parent or legal guardian to use Simply.

  • Account Information: Users agree to provide accurate and complete information during registration and to keep this information updated.

  • Compliance: Users agree to use Simply in accordance with all applicable laws and regulations in Saudi Arabia.

3. Service Usage

  • Activation: Users must follow the instructions provided within Simply for installing and activating eSIMs. ABAST AL-HALLOUL is not responsible for issues arising from failure to adhere to these instructions.

  • Device Compatibility: It is the user’s responsibility to ensure their device supports eSIM functionality and is unlocked for use with eSIMs.

  • Data Consumption: Users are responsible for monitoring their data usage. ABAST AL-HALLOUL is not liable for unexpected data consumption, including that from background applications.

4. Payment and Refund Policy

  • Payments: Users agree to pay all fees associated with the services as outlined within Simply. All payments are processed in Saudi Riyals.

  • Refunds: Refunds are not provided for unused data or services once an eSIM has been activated, except as required by Saudi Arabian consumer protection laws.

5. Intellectual Property

  • Ownership: All content, trademarks, and data within Simply are the property of ABAST AL-HALLOUL or its licensors and are protected by applicable intellectual property laws.

  • License: ABAST AL-HALLOUL grants users a limited, non-transferable license to use Simply for personal, non-commercial purposes.

6. Privacy and Data Protection

  • Data Collection: By using Simply, users consent to the collection and use of their personal data in accordance with our Privacy Policy and Saudi Arabian data protection regulations.

  • Data Security: ABAST AL-HALLOUL implements measures to protect user data but cannot guarantee absolute security. Users acknowledge and accept this risk.

7. Limitation of Liability

  • Service Availability: Simply is provided “as-is” and “as available.” ABAST AL-HALLOUL does not guarantee uninterrupted or error-free service.

  • Third-Party Services: Simply may include integrations with third-party services. ABAST AL-HALLOUL is not responsible for the availability or accuracy of such services.

  • Exclusions: ABAST AL-HALLOUL is not liable for indirect, incidental, or consequential damages resulting from the use of Simply.

8. Prohibited Activities

Users agree not to:

  • Use Simply for unlawful purposes or in a manner that violates Saudi Arabian laws.

  • Misrepresent their identity or use fraudulent payment methods.

  • Reverse engineer, decompile, or tamper with the Simply platform.

  • Use automated systems (e.g., bots) to interact with Simply without prior consent.

9. Indemnification

Users agree to indemnify and hold harmless ABAST AL-HALLOUL, its affiliates, and employees from any claims, damages, or liabilities arising from:

  • Their use of Simply.

  • Violation of these TOU.

  • Breach of any applicable laws or regulations.

10. Service Modifications

ABAST AL-HALLOUL reserves the right to modify, suspend, or discontinue any aspect of Simply at any time, with prior notice where feasible. ABAST AL-HALLOUL will not be liable for any impact resulting from such changes.

11. Governing Law and Dispute Resolution

  • Governing Law: These TOU are governed by the laws of Saudi Arabia.

  • Dispute Resolution: Any disputes arising from or related to these TOU shall be resolved through the competent courts of Saudi Arabia.

12. Amendments

ABAST AL-HALLOUL reserves the right to modify these TOU at any time. Users will be notified of significant changes through email or in-app notifications. Continued use of Simply after such changes constitutes acceptance of the new TOU.

13. Language

These Terms of Use are provided in English. For users in Saudi Arabia, an Arabic version is available upon request. In case of discrepancies between translations, the Arabic version shall prevail.

If users wish to withdraw their purchase before activation, they must submit a cancellation request through the Simply platform. Refunds, if applicable, will follow the refund policy.
